Welcome to TruViiant Brands. These Terms of Service govern your use of the TruViiant Brands website, online store, products, customization services, and related services.

Throughout these Terms, the words “TruViiant Brands,” “we,” “us,” and “our” refer to TruViiant Brands. The words “you,” “your,” and “customer” refer to the individual, business, church, ministry, nonprofit, organization, or other entity using our website or purchasing our products or services.

By visiting our website, creating an account, submitting a custom-order request, approving artwork, or purchasing a product or service, you agree to these Terms of Service and any policies incorporated into them.

If you do not agree with these Terms, please do not use our website or purchase our products or services.

1. Our Products & Services

TruViiant Brands provides apparel, headwear, accessories, custom printing, embroidery, branded merchandise, promotional products, personalized products, and related design and production services.

Products and services may include:

  • T-shirts
  • Hoodies and sweatshirts
  • Hats and headwear
  • Polos and business apparel
  • Jackets
  • Bags and accessories
  • Embroidery
  • DTF printing
  • Heat-transfer products
  • Sublimation products
  • Custom merchandise
  • Church and ministry apparel
  • Business and organizational apparel
  • Event and conference merchandise
  • Print-on-demand products
  • Other branded merchandise

Products and services may change or be discontinued at our discretion, subject to applicable law and existing customer obligations.

2. Online Store

Our online store may be operated using Shopify and may utilize third-party applications, payment processors, shipping carriers, print-on-demand providers, and fulfillment services.

Your use of certain third-party services may also be subject to those providers' applicable terms and policies.

3. Eligibility

By using our website or placing an order, you represent that you are legally capable of entering into a binding agreement or have appropriate authorization to make the purchase on behalf of the business or organization you represent.

You agree not to use our products or services for unlawful purposes.

4. Product Information

We make reasonable efforts to accurately display product descriptions, colors, images, specifications, dimensions, and pricing.

However, actual colors may appear differently depending upon:

  • Computer or mobile device displays
  • Lighting
  • Fabric
  • Manufacturing variations
  • Printing techniques
  • Embroidery thread
  • Production methods

Minor variations inherent to apparel manufacturing, printing, embroidery, or customization are not necessarily considered defects.

5. Pricing

Prices are displayed in U.S. dollars unless otherwise indicated.

TruViiant Brands reserves the right to change product prices, customization charges, setup fees, shipping costs, and other charges before an order is accepted.

For custom or bulk orders, the price contained in an approved quote or invoice will generally govern that transaction.

Applicable taxes and shipping charges may be added during checkout.

6. Orders

Submitting an order does not necessarily guarantee acceptance.

We reserve the right, consistent with applicable law, to decline or cancel an order for reasons including:

  • Product unavailability
  • Pricing or listing errors
  • Suspected fraud
  • Payment problems
  • Artwork concerns
  • Intellectual property concerns
  • Production limitations
  • Prohibited content
  • Inability to meet requested specifications

If we cancel a paid order before production for reasons attributable to TruViiant Brands, any appropriate refund will be processed.

7. Payment

Payment is required according to the terms displayed during checkout or stated on the applicable quote or invoice.

Custom and bulk orders may require:

  • Deposits
  • Setup fees
  • Digitization fees
  • Design fees
  • Production payments
  • Final payment before delivery

Customers authorize TruViiant Brands and its payment providers to process applicable charges associated with authorized orders.

8. Custom Orders

Custom merchandise is produced according to customer-selected or approved specifications.

Customers are responsible for carefully reviewing:

  • Artwork
  • Spelling
  • Names
  • Dates
  • Colors
  • Sizes
  • Quantities
  • Product selections
  • Design placement
  • Logos
  • Personalization

Custom orders are additionally governed by our Custom Orders & Artwork Approval Policy.

Once artwork has been approved and production has begun, changes or cancellations generally cannot be guaranteed.

9. Artwork Approval

When a proof is provided, the customer is responsible for reviewing the entire design before approving production.

Customer approval authorizes TruViiant Brands to produce merchandise substantially according to the approved specifications.

If an error appears on an approved proof and the finished product accurately reflects that proof, the customer may be responsible for the resulting merchandise.

If TruViiant Brands materially deviates from the approved proof or confirmed specifications, we will review the matter and determine an appropriate resolution.

10. Customer-Submitted Content

Customers may provide logos, graphics, photographs, names, trademarks, text, artwork, or other content for customization.

By submitting such material, you represent that you own it or have sufficient permission or legal authority to authorize its reproduction for the requested purpose.

You agree not to knowingly submit material that unlawfully infringes another person's:

  • Copyright
  • Trademark
  • Right of publicity
  • Privacy rights
  • Intellectual property rights

TruViiant Brands may decline production when we reasonably believe submitted material may violate applicable law or third-party rights.

11. Intellectual Property

Unless otherwise stated, TruViiant Brands' website content, branding, original designs, logos, graphics, photographs, written material, and other original creative assets are owned by or licensed to TruViiant Brands and are protected by applicable intellectual property laws.

They may not be reproduced, distributed, modified, commercially exploited, or represented as another party's work without appropriate authorization.

Customer-owned logos and intellectual property remain the property of their respective owners.

12. Design & Digitization Services

Certain artwork may require modification, recreation, vectorization, digitization, or other production preparation.

Additional charges may apply.

Embroidery digitization creates production instructions for embroidery equipment and does not necessarily constitute a transfer of ownership of the underlying artwork or production file.

Ownership or release of production-ready embroidery files should be determined by the applicable order agreement.

13. Print-on-Demand Fulfillment

Certain products may be manufactured and fulfilled by third-party print-on-demand partners.

This may include services provided through companies such as Printful, Printify, Apliiq, or other fulfillment providers selected by TruViiant Brands.

As a result, products within a single order may:

  • Be produced at different facilities
  • Arrive separately
  • Have separate tracking numbers
  • Have different production times

Customers should contact TruViiant Brands regarding problems with products purchased through our store rather than independently contacting our production partners unless instructed otherwise.

14. Shipping

Shipping is governed by our Shipping Policy.

Processing time and shipping time are separate.

Delivery dates provided through our website, production partners, or shipping carriers are generally estimates unless specifically guaranteed in writing.

TruViiant Brands is not responsible for delays caused by circumstances reasonably outside our control, subject to applicable consumer protection laws.

15. Returns, Refunds & Exchanges

Returns, refunds, and exchanges are governed by our Return & Refund Policy.

Eligible standard merchandise may qualify for return under the conditions specified in that policy.

Custom, personalized, embroidered, printed, and made-to-order merchandise is generally final sale except where the merchandise is defective, damaged, incorrectly produced, or otherwise eligible for a remedy under our policies or applicable law.

16. Cancellations

Standard merchandise orders should be canceled as quickly as possible.

Custom-order cancellations become increasingly difficult once artwork preparation, product ordering, digitization, printing, embroidery, or production has begun.

Costs already incurred before an approved cancellation may be non-refundable to the extent permitted by law and disclosed in the applicable order terms.

17. Bulk & Organizational Orders

Churches, ministries, businesses, schools, nonprofits, conferences, teams, organizations, and other customers placing larger orders may receive separate quotes, invoices, or agreements.

Those documents may contain additional terms regarding:

  • Deposits
  • Minimum quantities
  • Artwork
  • Production
  • Deadlines
  • Shipping
  • Delivery
  • Payment schedules
  • Cancellations

Where additional written terms apply to a particular transaction, those terms supplement these Terms of Service.

18. Event Deadlines

Customers purchasing merchandise for a conference, church service, anniversary, business event, reunion, celebration, or other time-sensitive occasion should disclose the required delivery date before production begins.

We will make reasonable efforts to meet accepted deadlines, but a requested event date is not automatically a guaranteed delivery date.

19. Promotional Codes & Discounts

Promotional offers may be subject to specific eligibility requirements, expiration dates, exclusions, or minimum purchases.

Unless otherwise stated, discounts generally cannot be combined.

TruViiant Brands may modify or discontinue promotions according to their stated terms and applicable law.

20. Gift Cards & Store Credits

When offered, gift cards and store credits are subject to applicable terms displayed when issued and applicable law.

Gift cards and store credits should be treated like cash and safeguarded accordingly.

21. Website Accounts

Customers may have the ability to establish an account through our website.

You are responsible for maintaining the confidentiality and security of your account credentials and for promptly notifying us if you believe your account has been compromised.

22. Electronic Communications

By providing your email address in connection with an order, you authorize us to send transactional communications reasonably necessary to process and service your purchase, including:

  • Order confirmations
  • Proof approvals
  • Production updates
  • Shipping notifications
  • Customer-service communications

Marketing email and text-message communications are subject to applicable consent requirements and available opt-out mechanisms.

23. Reviews, Photographs & Feedback

Customers may voluntarily submit reviews, photographs, comments, testimonials, or other feedback.

When submitting content for public display through our website or designated review systems, you grant TruViiant Brands permission to display and use that content for reasonable business and promotional purposes, subject to applicable law and platform terms.

Please do not submit confidential or proprietary information through public reviews.

24. Prohibited Uses

You may not use our website or services to:

  • Violate applicable laws
  • Commit fraud
  • Introduce malicious software
  • Interfere with website security
  • Misrepresent your identity
  • Infringe intellectual property rights
  • Attempt unauthorized access to our systems
  • Engage in abusive or deceptive transactions

We reserve the right to restrict access or decline service for conduct that violates these Terms, subject to applicable law.

25. Third-Party Services & Links

Our website may contain integrations or links involving payment processors, social media platforms, shipping carriers, production partners, or other third parties.

TruViiant Brands does not control every aspect of independent third-party websites and services.

Customers should review applicable third-party terms and privacy practices when interacting directly with those services.

26. Website Availability

We work to maintain a reliable online shopping experience, but we cannot guarantee uninterrupted website availability.

Maintenance, software updates, technical failures, internet outages, third-party service interruptions, or circumstances beyond our reasonable control may temporarily affect website functionality.

27. Privacy

Our collection and handling of personal information are governed by our Privacy Policy and applicable privacy laws.

Customers should review the Privacy Policy to understand how personal information may be collected, used, disclosed, retained, and protected.

28. Disclaimer of Warranties

To the extent permitted by applicable law, products and services are provided subject to the descriptions, warranties, and representations expressly provided by TruViiant Brands or applicable manufacturers.

Nothing in these Terms is intended to waive warranties, remedies, or consumer rights that cannot legally be waived.

29. Limitation of Liability

To the fullest extent permitted by applicable law, TruViiant Brands will not be liable for indirect, incidental, special, or consequential losses arising from the use of our website, products, or services where such limitations are legally permitted.

Nothing in these Terms excludes liability that cannot lawfully be limited or excluded.

30. Indemnification

To the extent permitted by law, customers agree to indemnify and hold TruViiant Brands harmless from third-party claims arising from customer-submitted artwork, trademarks, logos, photographs, or other materials when the customer did not possess the necessary rights or authorization to use those materials.

31. California Law

Unless applicable law requires otherwise, these Terms will be governed by the laws of the State of California, without regard to conflict-of-law principles.

Nothing in these Terms is intended to restrict consumer rights provided under applicable federal, state, or local law.

32. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

33. Changes to These Terms

TruViiant Brands may update these Terms periodically to reflect changes in our operations, products, services, technology, fulfillment arrangements, or legal requirements.

The current version will be posted on our website with an updated effective date.

Changes will apply prospectively unless otherwise required by law.

34. Entire Agreement

These Terms, together with applicable policies, order confirmations, approved quotes, invoices, artwork approvals, and other written agreements applicable to a transaction, constitute the agreement between the customer and TruViiant Brands concerning that transaction.
